Terms of Use — HealthNav

1. Acceptance of Terms

By downloading, installing, or using the HealthNav mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.

2. Description of Service

HealthNav is a healthcare navigation and administrative tool that helps users:

Organize and interpret medical orders using AI assistance
Find in-network healthcare providers
Navigate insurance coverage and booking resources

        HealthNav is an educational and administrative tool only. It does not provide medical advice, diagnosis, or treatment. Nothing in the App constitutes a doctor-patient relationship.
      

3. Medical Disclaimer

⚠️ IMPORTANT: HealthNav is not a medical service. The information provided is for informational and navigational purposes only. Always consult a licensed healthcare professional for medical advice. Always verify insurance coverage directly with your plan before scheduling appointments.

4. Freemium Model and Subscription

4.1 Free Tier

The following features are available at no cost:

Upload and AI-assisted reading of medical orders
In-network provider search
Distance and rating filters
Amazon Pharmacy and GoodRx links
Order history (last 3 orders)

4.2 Premium Subscription ($4.99/month)

Premium features include:

Cost Estimator (copay/deductible estimates)
Unlimited order history
Exam Checklist
Pending Exam Alerts
Price Comparison between providers
Family Plan (up to 5 members)

4.3 Billing

Subscriptions are billed monthly through the App Store (Apple) or Google Play.
Prices may vary by region due to local taxes.

4.4 Cancellation

You may cancel your subscription at any time through your App Store or Google Play account settings.
Cancellation takes effect at the end of the current billing period.
No partial refunds are issued for unused subscription periods.

4.5 Refunds

Refund requests are handled by Apple or Google per their respective policies.

5. AI-Assisted Features

The App uses OpenAI's GPT-4o Vision model to extract exam names from medical order photos. By using this feature, you acknowledge:

Medical images are transmitted to OpenAI's servers for processing
You have the right to upload the images you submit
Results may not be 100% accurate — always verify with your healthcare provider

6. Third-Party Services

The App integrates with or links to third-party services including Zocdoc, Amazon Pharmacy, GoodRx, insurance plan portals, and the CMS NPI Registry. We are not responsible for the content, accuracy, or practices of these services. Your use of third-party services is subject to their respective terms and policies.

7. User Responsibilities

You agree to:

Provide accurate insurance information
Use the App for lawful purposes only
Not attempt to reverse engineer, copy, or redistribute the App
Not use the App for any commercial purpose without written consent

8. Intellectual Property

All content, design, code, and branding in the App are the property of HealthNav and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

HealthNav provides the App "AS IS" without warranties of any kind
We are not liable for any inaccuracies in AI-extracted exam data
We are not liable for provider availability, pricing, or insurance coverage decisions
We are not liable for any medical, financial, or consequential damages arising from use of the App
Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless HealthNav, its officers, directors, and agents from any claims arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

12. Modifications

We reserve the right to modify these Terms at any time. We will notify users of material changes via the App. Continued use after notification constitutes acceptance.

13. Termination

We reserve the right to suspend or terminate access to the App for violations of these Terms, at our sole discretion.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

15. Dispute Resolution

Before initiating any legal proceedings, you agree to attempt to resolve disputes informally by contacting us at legal@gethealthnav.com. We will attempt to resolve disputes within 30 days.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force.
